Consequences of a First DUI Conviction

In Massachusetts, it is unlawful to operate any type of motor vehicle (including a boat) if you have a blood alcohol concentration (BAC) of .08% or greater, or of .02% or greater if you are under 21. For a first offense of this nature in Worcester, Massachusetts, a defendant may face serious criminal penalties:

  • Driver's license suspension for 1 year (eligible to apply for a Hardship License after 3 months)
  • Maximum term of imprisonment of 2.5 years
  • Fine of up to $5,000

Most first time offenders, however, may qualify for alternative sentencing under what is known as the "24D Program." In these situations, the defendant may be able to avoid imprisonment by participating in a mandatory drug-alcohol education program. A driver who is under the age of 21 or who has refused a Breathalyzer test may face enhanced penalties.

Involving a Worcester DUI Lawyer

If this is your first DUI or OUI offense, do not underestimate the positive impact that a competent Worcester DUI Lawyer may have on the outcome of your case. You may be in danger of being ineligible for alternative sentencing to avoid jail time, and as such it is important that you take no chances with your case. Massachusetts employs a "lifetime look-back" period on drunk driving offenses, and this means that any previous conviction (even out of state or that may have occurred years ago) may count as a previous conviction and classify you as a repeat offender.
