In Massachusetts, it is unlawful to operate any type of motor vehicle (including a boat) if you have a blood alcohol concentration (BAC) of .08% or greater, or of .02% or greater if you are under 21. For a first offense of this nature in Worcester, Massachusetts, a defendant may face serious criminal penalties:
- Driver's license suspension for 1 year (eligible to apply for a Hardship License after 3 months)
- Maximum term of imprisonment of 2.5 years
- Fine of up to $5,000
Most first time offenders, however, may qualify for alternative sentencing under what is known as the "24D Program." In these situations, the defendant may be able to avoid imprisonment by participating in a mandatory drug-alcohol education program. A driver who is under the age of 21 or who has refused a Breathalyzer test may face enhanced penalties.
