Breath and Chemical Tests

DUI and OUI in Worcester, Massachusetts

After a drunk driving arrest in Worcester, Massachusetts, you will be asked to submit to a chemical test which will determine your blood alcohol concentration (BAC) - the level of alcohol in your system. Most often, a breath test will be performed to determine your BAC, but you may request a blood test instead. Although you may have submitted to this test and showed a result of .08% or greater (above the legal limit in Massachusetts) this does not necessarily mean that you are guilty or should be convicted of Operating Under the Influence (OUI).

Breath Test Results & License Suspension

Massachusetts law allows for the testing of a driver's blood alcohol level by either a blood or breath analysis. A valid breath test or blood test result of .08% or greater (or .02% or greater for underage drivers) will result in the Registry of Motor Vehicles beginning proceedings to suspend your driver's license for 30 days. However, if you act within 15 days of the date of your arrest you have the right to request a Registry Hearing to challenge the suspension or seek a Hardship License at the very least.
