The DUI Process
A DUI/OUI arrest will generate two separate legal processes: a hearing with the Registry of Motor Vehicles and a criminal case at Worcester District Court. These are two completely separate processes, and the outcome of one does not affect the outcome of the other.
The registry hearing is your chance to contest the suspension of your driver's license. As soon as you are placed under arrest for OUI/DUI your driver's license will automatically be suspended. This hearing is your opportunity to fight for your driving privileges back. The important thing to remember about the RMV hearing is that you only have 15 days to schedule this hearing. If you do not schedule your hearing within the 15 days following your arrest, you will lose your right to the hearing, and ultimately your right to fight your suspension.
The second part of a DUI case is of course the criminal process. The criminal case begins with the arraignment, which will be your first court appearance. At the arraignment, the judge will read the charges that have been filed against you, after which you will enter your plea of guilty or not guilty. A pre-trial conference is then set, and you and your attorney will need to decide whether to proceed forward to trial or try to work out a plea bargain with the District Attorney.
