Under Massachusetts OUI law, a person is considered too intoxicated to be operating a motor vehicle when their blood alcohol concentration reaches .08 percent or higher.  At this point, the driver's physical coordination and mental alertness has been compromised, increasing their chances of causing an accident and harming others.
