About OUI in Massachusetts
In Massachusetts, drunk driving charges are referred to as OUI (Operating Under the Influence.) However, most people refer to this criminal offense as DUI, or Driving Under the Influence. It involves operating a motor vehicle while with a blood alcohol concentration of .08% or greater or while one's physical and/or mental abilities are impaired due to alcohol or drug use.
Massachusetts recently became a "per se" state. This means that if your breathalyzer test result was .08% or above, you will be found guilty if, and only if, the Judge or jury believes the breath test was conducted properly and the reading was accurate.
The Commonwealth of Massachusetts, through the Worcester County District Attorney's Office, must prove beyond a reasonable doubt three separate and distinct elements of the offense. The prosecutor must present evidence, beyond a reasonable doubt, that at the time of your arrest, you were:
